Legislation Update

There are a number of bills before Congress of interest to servicemembers and veterans that are just starting to work their way through both houses. Here are their summaries.


H.R. 1824

Title: To amend title 38, United States Code, to expand the scope of programs of education for which accelerated payments of educational assistance under the Montgomery GI Bill may be used, and for other purposes.

Sponsor: Representative Michael H. Michaud [D-Maine]

Military education assistance cannot be considered as income for purposes of determining eligibility for education grants or loans under any other provision of federal law.

Referred to the House Subcommittee on Military Personnel.


S.723 IS MONTGOMERY GI BILL ENHANCEMENT ACT OF 2007

Title: A bill to provide certain enhancements to the Montgomery GI Bill Program for certain individuals who serve as members of the Armed Forces after the September 11, 2001, terrorist attacks, and for other purposes.

Sponsor: Senator Chuck Hagel [R-Nev.] (introduced 3/01/2007)

This bill would eliminate the current Montgomery GI Bill’s $1,200 enrollment fee ($100 per month for first 12 months of active duty) for members of the Armed Forces, including Reserve and National Guard on active duty during the period after President Bush’s November 2001 Executive Order that placed the military on a wartime footing. It provides for reimbursement of payroll deductions taken prior to the enactment of this act. It allows members to withdraw an election not to receive basic educational assistance.

Read twice and referred to the Senate Committee on Armed Services.


S.22 POST-9/11 VETERANS EDUCATIONAL ASSISTANCE ACT OF 2007

Title: A bill to amend title 38, United States Code, to establish a program of educational assistance for members of the Armed Forces who serve in the Armed Forces after September 11, 2001, and for other purposes.

Sponsor: Senator Jim Webb [D-Va.] (introduced 1/04/2007)

The legislation seeks to provide veterans of the 9/11 era with educational benefits parallel to those provided to service members at the end of World War II, when the GI bill spurred economic growth and expansion for a whole generation of Americans.

HR 81
BARTLETT MONTGOMERY GI BILL

Title: To amend title 38, United States Code, to providethatmembersoftheArmed Forces and Selected Reserve may transfer certain educational assistance benefits to dependents, and for other purposes.

: Representative Roscoe G. Bartlett. [R-Md.] (introduced 1/04/2007)

This would allow unused GI Bill benefits to be transferred to family members. This bill would encourage Active Duty and Reserve servicemembers to re-enlist, support military families and provide more realistic rates of educational costs for higher learning by permitting servicemembers to transfer unused GI education benefits to their spouses or children. In general, this bill would amend the Montgomery GI Bill educational assistance program to allow an individual who has completed six years of service in the Armed Forces and enters into an agreement to serve at least four more years to transfer their educational assistance entitlement to their spouse, child, or a combination. It would provide for a percentage annual increase in the rates of assistance.

H.R. 1641
MONTGOMERY GI BILL INTEGRATION ACT OF 2007

Title: To amend title 38, United States Code, to recodify as part of that title certain educational assistance programs for members of the reserve components of the Armed Forces.

Sponsor: Representative Vic Snyder [D-Ark.] (introduced 3/22/2007)

This would provide educational assistance to members of the Selected Reserve of the Ready Reserve who agree to remain members of the Selected Reserve for a period of not less than six years.

The educational assistance allowance shall be paid at the following rates, with increases based on the Consumer Price Index:

• $309 per month for each month of full-time pursuit of a program of education.
